ABOUT THE SEMINAR
Independent contractors are again in the spotlight through the decision of the Full Court of the Federal Court of Australia (Court) to dismiss the appeal and cross-appeal in the matter of Dental Corporation Pty Ltd v Moffet [2020] FCAFC 118. The Court found that Dr Moffet fell within the extended definition of an employee under the Superannuation Guarantee (Administration) Act 1992 (Act) and that Dental Corporation Pty Limited was obliged to make superannuation contributions on his behalf.
This decision again highlights potential risks, particularly with respect to superannuation, which can arise through independent contractor arrangements.
