Madelaine Inglis heads our elder law practice and has over 25 years experience as a commercial lawyer. She also advises clients and their advisors on estate planning, franchising and property law.

Madelaine is particularly passionate about elder law, assisting the older members of our community and their families with legal issues unique to the elderly. Madelaine provides legal advice that is tailored to provide practical assistance at what can often be a confronting, difficult and stressful period of people’s lives.

Relevant areas covered by our elder law practice include:

  • Wills (including testamentary trusts)

  • Enduring powers of attorney

  • Appointment of enduring guardians and making health care directives

  • Assisting with applications to NCAT (eg for appointment as a guardian and/or financial manager)

  • Conveyancing (eg the sale or lease of the family home, facilitating entry into a retirement village)

  • Contract advice (eg relating to entry into an aged care facility or transferring between facilities)

  • Asset protection

  • Superannuation and pension entitlements

  • Elder abuse or discrimination claims

  • Administration of estates

  • Estate disputes

Madelaine also advises on estate planning generally outside of her elder law practice.

Her franchising law experience includes advising on all aspects of franchising for both franchisors and franchisees across a range of industries including:

  • Developing and implementing franchising systems and documentation (including franchise agreements and other disclosure documents)

  • Advising clients regarding the Franchising Code of Conduct to ensure a franchise system and its related documentation complies with the Code and other relevant legislation including the Personal Property Securities Act 2009

  • All property-related matters including leases and licences

  • Buying and selling franchise businesses including exiting a franchise

Madelaine also has extensive experience in property law including property acquisitions and investments, developments, construction, leasing, financing and asset protection structuring. She has acted for a wide range of clients including property developers, individual and company investors, builders, Australian public companies and franchisors and franchisees. 

She is a member of the board of directors of Windgap Foundation Limited. Windgap is a public benevolent institution which provides a wide range of services to people with intellectual disabilities and their families.
